Terms of service

Welcome to The Luc Cochran Foundation (TLCF). By accessing or using any of TLCF’s services, platforms, websites, or mobile applications (collectively referred to as “Services”), you (“User”) agree to comply with and be bound by these Terms of Service (“Terms”). These Terms govern your use of our Services, which include, but are not limited to, our educational programs, volunteer activities, fundraising initiatives, and other offerings. If you do not agree with these Terms, you must refrain from using our Services.

By using TLCF’s Services, you agree to comply with all applicable local, state, and federal laws and regulations, respect TLCF’s mission, values, and Code of Conduct, take responsibility for any content you submit (including comments, images, and videos), and notify TLCF immediately of any unauthorized use of your account or personal information. TLCF offers a range of services, including educational support such as tutoring, mentorship, and job readiness programs; fundraising activities, including donations, events, and campaigns; volunteer opportunities; and partnerships with organizations and individuals aligned with TLCF’s objectives.

As a User, you are expected to provide accurate and current information when registering or interacting with our Services, use our Services only for lawful purposes in support of TLCF’s mission, respect the rights of other users, volunteers, participants, and staff, and avoid any actions that could disrupt or damage our systems, such as hacking, uploading malware, or using abusive language. Prohibited conduct includes harassment, verbal abuse, bullying, intimidation, discrimination based on race, gender, religion, sexual orientation, disability, or any protected characteristic, engagement in illegal activities such as theft, fraud, or unauthorized access to personal data, and sharing offensive or obscene content, including hate speech, graphic violence, or pornography.

TLCF is committed to protecting your privacy and personal data. By using our Services, you consent to the collection, storage, and processing of your personal information in accordance with our Privacy Policy. Some Services, including certain educational programs and events, may require payment. You agree to pay all applicable fees, make donations in good faith, and understand that donation processing fees may apply. Donations are non-refundable unless explicitly stated, while service fees may be refunded on a case-by-case basis at TLCF’s discretion. Late payments may result in suspension of access to Services until payment is received.

TLCF reserves the right to suspend or terminate your access to Services, with or without notice, if you violate these Terms, engage in conduct harmful to the organization or its stakeholders, or participate in fraudulent or unlawful activities. Even after termination, obligations such as payment, indemnity, and dispute resolution remain in effect.

All disputes arising from these Terms must be resolved through binding arbitration, governed by the rules of a mutually agreed-upon arbitration service, and conducted in the state of Georgia, USA. You agree not to participate in class or collective actions, and any claims will be limited to the amount you have paid for the specific Services in question. Punitive damages and collective relief are not permitted. Users are solely responsible for all arbitration costs, including filing, administrative, and arbitrator fees. By agreeing to these Terms, you waive your right to a jury trial or class action lawsuit.

You agree to indemnify and hold harmless TLCF, its officers, directors, employees, agents, and affiliates against any claims, damages, liabilities, or expenses (including attorney’s fees) resulting from your use of the Services, your breach of these Terms, or your violation of others’ rights. TLCF’s liability is limited to the amount you paid for the Services in question and excludes any indirect, incidental, or consequential damages, including loss of profits.
